California police declare new war
on medical marijuana patients
SAN FRANCISCO, CA -- Members of the American Medical Marijuana Association are reporting a dramatic increase in the arrests of bona fide medical marijuana patients statewide, as a result of a recent court decision that was supposed to help, not harm patients.

On May 22, 2008, the Second District of California Court of Appeals ruled that the state limits on medical marijuana possession and cultivation established under state law SB 420 are unconstitutional.  In the case People v. Patrick Kelly, the court overturned defendant's conviction for possessing 12 ounces of dried marijuana plants on the grounds that the prosecutor had improperly argued that the defendant was guilty because he possessed more than the 8-ounce limit established in Health & Safety Code Sec. 11362.77 and did not have a doctor's recommendation authorizing more.

In a 3-0 decision, the court ruled: "The prosecutor's argument was improper. It was improper because the CUA [Compassionate Use Act] can only be amended with voters' approval. Voters, however, did not approve the eight-ounce limit and other caps in section 11362.77 [of SB420]; hence, section 11362.77 unconstitutionally amends the CUA."

While this decision was clearly intended to protect the rights of the patients, the court's declaration that this section of SB 420 is unconstitutional has been interpreted by police to mean that ANY amount of medical marijuana could be too much for personal use and is therefore illegal.  As a result, we are seeing cases where police are arresting bona fide patients for as little as 2 ounces, even in places like Mendocino County.

AMMA advises patients to respond to this serious threat as follows:

1.  Do not speak to police.  Be courteous, but do not tell police anything, even if you are sure it will prove your innocence.  Police are highly skilled at twisting whatever you say into something that can be used against you or used to gain entry to your home or vehicle.

2.  Only you and your doctor are qualified to judge how much medical marijuana is appropriate for you to grow and possess.  If the amount that you require is greater than the limits set by SB420, then ask your doctor to say so in his recommendation letter to you.  Those limits may be unconstitutional as a sword, but the numbers can still be used as a shield to create immunity for you - with your doctor's help.

3.  If your doctor won't cooperate, document your usage.  Document crop loses from mites or mildew and such. Document how you use the cannabis you grow and how much is consumed by various methods you may use such as vaporizing or cooking.

4.  Use a PO box, not a physical address, on your license.  We see a lot of cases where police make an arrest for possession in a vehicle and then show up at the home address on the license with a warrant and a raid.

5.  There is safety in numbers.  Get active in organizations like AMMA, NORML, ASA, MMP and the Libertarian or Green Parties.  Show your support for other patients, especially in court.  Sure, you are more visible and exposed than if you hide at home, but hiding is no assurance of safety.  Becoming an activist teaches you valuable lessons in how to stay safe, while helping others and protecting the rights and safety of sick people. In 1974 researchers at the Medical College of Virginia, who had been funded by the National Institute of Health to find evidence that marijuana damages the immune system, found instead that THC slowed the growth of three kinds of cancer in mice - lung and breast cancer, and leukemia. A quarter century later, scientists in Spain repeated this experiment and got the same incredible results.

A 2002 review of seven separate studies involving 7,934 drivers reported, "Crash culpability studies have failed to demonstrate that drivers with cannabinoids in the blood are significantly more likely than drug-free drivers to be culpable in road crashes." This result is likely because subject under the influence of marijuana are aware of their impairment and compensate for it accordingly, such as by slowing down and by focusing their attention when they know a response will be required. This reaction is just the opposite of that exhibited by drivers under the influence of alcohol, who tend to drive in a more risky manner proportional to their intoxication.

AMMA was founded in cyberspace on October 27, 1999.

We are a group of volunteers working together to implement, preserve and protect the rights of medicinal cannabis patients through political activism. Our platform is based on the idea of not bargaining away people's rights. We believe that each person will have different needs, which are best determined by the patient and physician. What works well for one patient may not work for another.

Our activism includes aiding in the defense of cannabis patients should they be so unfortunate as to be prosecuted for their choice of medication. One way we are able to do this is through the sharing of successful motions, writs, declarations and demands.

Because California seems to be the testing grounds for medical cannabis patients it is not surprising to see most of the information originating from that state. AMMA's goal is to preserve California Health & Safety Code Sect. 11362.5, The Compassionate Use Act of 1996. This was a well-written law that law enforcement officers say is too vague. However, this law was not vague to the voters of California when they voted for it. Law enforcement is trying to re-write the law, infringing upon the rights of the voters, placing conditions that violate the California State Constitution. Law enforcement has been ignoring the will of the voters. There are political words that define this type of behavior against citizens.
